Conditional Green Card

After you complete the marriage green card process and the interviewing USCIS officer approves your case, you will either be issued a permanent green card or a conditional green card. A permanent green card shows a validity date of 10 years and can easily be renewed by the green card holder. A conditional green card is valid for two years and a separate application for a permanent green card must be filed in the three month period before it expires.

There are five pathways to applying for a permanent green card from a conditional green card.

1. Making a joint application with your US citizen spouse who sponsored you for the conditional green card. You must be married and not separated;

2. Making a individual application because your US citizen spouse is deceased;

3. Making an individual application where you divorced or your marriage was annulled but you entered the marriage in good faith;

4. Making an individual application where you were battered or subjected to extreme cruelty by your US citizen spouse;

5. Making an individual application where the termination of your status and removal from the US would result in extreme hardship.
