How long does it take to get marriage green card?
It generally takes 4-8 months after filing to obtain the marriage green card. We list state by state processing times here.
Do I need to be in the US to apply for a marriage green card?
Technically no but processing times will be over a year just to get the paperwork approved so you may enter the US. Normally, it would be better to obtain a spouse or fiancee visa to enter the US and then apply for the marriage green card.
When will I be able to legally work and travel internationally?
When applying for the marriage green card, you can also apply for permission to work and permission to travel internationally. Normal processing times are two to four months for the travel documents and 3 months for the work permit. We have been able to obtain work permits in as little as two weeks and travel documents in one week. Contact us for more information.
What about my children? Can they obtain a green card as well?
Absolutely. However, to be afforded quick processing, they will need to be in the US and apply prior to their 21st birthday. If they are overseas, are over 21 or are ineligible for any other reason, we can still help but it will take longer than 4-8 months.
What is an affidavit of support and what are the requirements?
In order for the US spouse to sponsor a foreign spouse for a marriage green card, he or she must show that he or she is financially able to support the foreign spouse. To prove this the US spouse must show that he or she has a certain level of income or a certain amount of financial assets. If the US spouse is unable to meet this requirement, the foreign spouse may show that they have a sufficient level of income or assets or the US spouse may ask another person to act as a financial co-sponsor.
Can I get a marriage green card if I am out of status?
Yes, we can still help you obtain a marriage green card even if you are out of status. We have helped many foreign nationals obtain marriage green cards even if they fell out of status.
Can I get a marriage green card if I entered the US without a visa or used a fraudulent passport?
The law requires that you were inspected by immigration officials in order for you to apply for a marriage green card, with some exceptions. If you used a fraudulent passport or visa to enter, this may still be considered an inspection but we will have to speak with you to be sure.
What is a conditional green card? Is it the same as a green card?
A conditional green card is issued in marriage green card cases where the marriage was less than two years old at the time the green card was approved. It is valid for two years and an application to waive the conditions must be filed and approved prior to obtaining a permanent green card.
I previously obtained my conditional green card but am now having marital problems? Can you help me?
