Marriage Green Card Interview

The interview is the focal point of the entire process. A failed interview will result in a denied application which could result in removal proceedings (deportation) if the foreign national does not have a valid nonimmigrant status or if the interviewing officer believes the applicant committed visa fraud or is inadmissible or excludable. Therefore, it is very important to take control and make sure that the interview goes as smoothly as possible. This is why it is highly recommended to have an immigration lawyer accompany you to the interview. we conduct mock interviews with our clients and prepare them for what really happens at the local USCIS offices.

The primary focus at the interview, assuming there are no inadmissibility or excludability issues, is the marital relationship. The officer wants to be sure that this is not a marriage of convenience or that the marriage took place just to obtain an immigration benefit. Documenting you life together is can be difficult but it is something that must be done to ensure a smooth interview.

In circumstances where the interviewing officer believes that the marriage is a sham, it is common for the couple to be separated and interrogated. How you arrange your bedroom furniture and what you ate for dinner last night can determine whether your case is approved or denied. it may sound ridiculous, but simple questions like these can show whether you are really living as a couple or are faking it. Inconsistent answers will lead to denial and possible criminal charges.

By law, you may be imprisoned for not more than five years or fined $250,000, or both, for entering into a marriage contract for the purpose of evading any provision of the immigration laws. In addition, you may be fined up to $10,000 and imprisoned for up to five years, or both, for knowingly and willfully falsifying or concealing a material fact or using any false document in submitting the application.

If the interviewing officer is satisfied that there is a bonafide marriage and the foreign national is eligible for the green card, he or she will inform the couple that their case will be approved. from that point, the foreign national will receive his or her green card in the mail in 2-4 weeks.
